Agreement to Terms

These Terms of Service ("Terms") form a legally binding agreement between you and Melissa Renae Esthetics LLC ("Melissa Renae Esthetics," "we," "us," or "our") regarding your access to and use of this website and related online services (collectively, the "Site").

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

Changes to These Terms

We may update these Terms from time to time. Changes are effective when posted on this page unless a later date is stated. Your continued use of the Site after updated Terms are posted constitutes acceptance of the updated Terms.

Eligibility and United States Use Only

You represent that you are at least 18 years old and legally capable of entering into these Terms.

The Site is intended for users located in the United States. Access from other locations may be unavailable or restricted.

Services and Informational Content

Melissa Renae Esthetics provides professional esthetics and beauty-related services. Any service descriptions, availability, treatment details, pricing, and scheduling information are informational and may change at any time without notice.

Content on the Site is for general informational purposes only and is not medical advice, diagnosis, or treatment. You should consult an appropriate licensed healthcare professional for medical concerns.

Third-Party Booking, Shopping, and Links

The Site may link to third-party services, including GlossGenius for appointment booking and Shopify-hosted services for retail purchases.

Those third-party services are independent from us and operate under their own terms, privacy policies, and practices. We are not responsible for third-party sites, content, products, services, availability, billing, shipping, returns, or security practices.

Appointment Scheduling, Cancellations, and Fees

Your appointment time is reserved exclusively for you. By booking an appointment, you agree to the following policy:

• to reschedule or cancel, you must provide notice at least 24 hours in advance of your appointment
• cancellations made within 24 hours of the appointment are subject to a 25% fee of the booked service total
• no-shows are treated as late cancellations and are subject to the same 25% fee
• if you arrive late, we may shorten or cancel the appointment; if canceled due to lateness, the 25% late-cancellation fee applies
• you authorize Melissa Renae Esthetics LLC or its booking provider to charge applicable cancellation or no-show fees to your payment method on file, to the extent permitted by law and applicable booking-provider terms
• repeated late cancellations or no-shows may require prepayment for future bookings and/or may result in refusal of future booking requests
• except where required by law, cancellation and no-show fees are non-refundable

We may grant exceptions in limited circumstances at our sole discretion. Any one-time exception or waiver does not waive our right to enforce this policy in the future.

Acceptable Use

You agree not to:

• use the Site in violation of any law or regulation
• interfere with Site operations, servers, or networks
• attempt unauthorized access to any portion of the Site or related systems
• use bots, scrapers, or similar tools to collect Site data without written permission
• upload or transmit malicious code or harmful content
• impersonate any person or provide false or misleading information

Intellectual Property and Limited License

All Site content, including text, graphics, branding, logos, layouts, and design elements, is owned by Melissa Renae Esthetics LLC or its licensors and is protected by intellectual property laws.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial use only. No right, title, or interest is transferred to you.

Feedback

If you provide comments, ideas, or suggestions regarding the Site, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use and exploit that feedback without restriction or compensation to you.

Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM HARMFUL COMPONENTS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MELISSA RENAE ESTHETICS LLC AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (USD $100) OR (B) THE AMOUNT YOU PAID DIRECTLY TO US FOR USE OF THE SITE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Melissa Renae Esthetics LLC and its owners, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• your use or misuse of the Site
• your violation of these Terms
• your violation of any law or third-party right

Termination

We may suspend or terminate your access to the Site at any time, with or without notice, if we reasonably believe you have violated these Terms, create risk for us, or if discontinuing Site operations is necessary.

Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and general provisions.

Dispute Resolution, Venue, and Class Action Waiver

To the maximum extent permitted by law, any dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in Tulsa County, Oklahoma, and each party consents to personal jurisdiction and venue in those courts.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND MELISSA RENAE ESTHETICS LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL ACTION.

Governing Law

These Terms and any dispute related to these Terms or the Site are governed by the laws of the State of Oklahoma and applicable U.S. federal law, without regard to conflict-of-law rules.

Privacy

Your use of the Site is also governed by our Privacy Policy.

General Provisions

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any provision of these Terms is not a waiver of future enforcement.

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
